Housing law: Introduction to tenancy law


This half-day session will look at how to create a Tenancy Agreement. It will also examine the rules relating to different types of tenancies, focusing on the Scottish Secured Tenancy and the Short Scottish Secured Tenancy. Reference will also be made to Assured and Short Assured Tenancies.

Learning Outcomes/objectives

By the end of this specialist course you will be able to:

• Define the different types of tenancy which exist in Scotland, with an emphasis on the Scottish Secure Tenancy

• Understand how tenancies are created

• Understand the importance of the relevant statutory rules which relate to the different types of tenancies in Scotland

Who should attend

Staff working in housing management. The course will be particularly useful for front line staff and housing managers who have specific responsibility with tenants at the time of tenancy sign up.

Trainer Info

Susan McDonald is a partner with HBJ Gately law firm. Susan has specialised in social housing and regeneration law since joining the firm in 1998. She has a particular focus on housing management and leads the low cost home ownership unit within her team, in addition to dealing with conveyancing for development sites and refinance transactions. Susan has been involved with numerous large scale stock transfers, mixed tenure development transactions, regeneration projects and a large number of development site acquisitions for social landlords. She has also been involved in a significant number of large volume refinances on behalf of clients. She regularly presents at conferences on a wide range of topics within the social housing sector, was a member of the Scottish government's sounding board for the evaluation of the Mortgage To Rent Scheme and is a committee member of Ore Valley Housing Association Ltd. Susan is currently advising clients on the impact of the Property Factors legislation.
